
{"id":40952,"date":"2022-05-10T12:22:56","date_gmt":"2022-05-10T10:22:56","guid":{"rendered":"https:\/\/castegnaro.preprod.web-sites.lu\/?p=40952"},"modified":"2022-12-06T16:44:35","modified_gmt":"2022-12-06T15:44:35","slug":"proposition-de-loi-relative-au-travail-fourni-par-lintermediaire-dune-plateforme","status":"publish","type":"post","link":"https:\/\/castegnaro.preprod.web-sites.lu\/en\/proposition-de-loi-relative-au-travail-fourni-par-lintermediaire-dune-plateforme\/","title":{"rendered":"Bill on work provided via a platform"},"content":{"rendered":"<div name=\"module-insight-bloc-paragraph\" class=\"container-px-25 mt-30 paragraph-body-small lg:mt-20 lg:text-20\">\n    \n    <p>Bill no. 8001<em>hereinafter referred to as \u00ab\u00a0<strong>the bill<\/strong>\u00a0\u00bb<\/em>) on work provided via a platform was submitted to the Chamber of Deputies on 4 May 2022.<\/p>\n<p>The bill aims to establish a\u00a0<strong>new national legal framework<\/strong>\u00a0to regulate the employment relationship of natural persons who provide services\/work via platforms when their usual place of work is located on the territory of Luxembourg.<\/p>\n<p>The main new provisions introduced by the bill are as follows:<\/p>\n<ul>\n<li><strong>To whom should this new legal framework apply?<\/strong><\/li>\n<\/ul>\n<p>This new law is intended to apply to employment relationships involving\u00a0<strong>individuals who provide services\/work<\/strong>\u00a0via\u00a0<strong>a digital platform<\/strong>\u00a0and who are regarded as employees of the digital platform within the meaning of the new national provisions when\u00a0<strong>their usual place of work is in Luxembourg or when their virtual place of work is in Luxembourg.<\/strong>.<\/p>\n<p>The bill provides the following definitions:<\/p>\n<ul>\n<li>The\u00a0<strong>person providing a service\/work<\/strong>\u00a0via a platform is \u00ab\u00a0<strong>a natural person<\/strong>\u00a0who\u00a0<strong>provides a service\/work for the benefit of another natural or legal person<\/strong>, called the beneficiary,\u00a0<strong>via a platform<\/strong>\u00a0\u201d.<\/li>\n<li>The\u00a0<strong>plateform<\/strong>\u00a0refers to \u00ab any\u00a0<strong>natural or legal person<\/strong>\u00a0who\u00a0<strong>organises services\/work for its own benefit or for the benefit of other natural or legal persons called the beneficiary(ies)<\/strong>\u00a0and\u00a0<strong>who connects a person providing a service\/work<\/strong>\u00a0through it with\u00a0<strong>the beneficiary<\/strong>\u00a0en se servant d\u2019une vitrine digitale ou d&rsquo;un quelconque moyen \u00e9lectronique et qui est le potentiel employeur de la personne prestant un travail\/service\u00a0\u00bb.<\/li>\n<li>The notion of a virtual workplace means \u00ab\u00a0<strong>the place where the service is received by the beneficiary of the service\/work<\/strong>\u00a0carried out by the person providing a service\/work via a platform, without the person providing a service\/work via a platform having travelled to the country where the service is received\u00a0\u00bb.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li>\u200b\u200b\u200b\u200b\u200b\u200b\u200b\u200b\u200b\u200b\u200b\u200b\u200b\u200b\u200b\u200b\u200b\u200b\u200b\u200b\u200b<strong>Employment contract between the platform and the service\/work provider ?<\/strong><\/li>\n<\/ul>\n<p>The bill sets out criteria for determining whether a job is carried out via a platform and creates\u00a0<strong><u>a presumption of the existence of an employment contract as soon as one or more of the criterion set out is fulfilled<\/u><\/strong>. This presumption can be overturned by the platform if it can be demonstrated that there is no employment contract.<\/p>\n<p>Nevertheless, when<strong>at least three of the criteria set out are fulfilled<\/strong>,\u00a0<strong>the existence of an employment contract within the meaning of article L.121-1 of the Labour Code is established<\/strong>, without\u00a0<strong>evidence to the contrary being admissible.<\/strong>.<\/p>\n<p>The criteria set out in the bill are as follows:<\/p>\n<ul>\n<li>\u201cThe platform advertises itself on the market by offering the service(s) or work\u201d;<\/li>\n<li>\u201cThe platform defines the conditions for (the person providing or being willing to provide the service\/work) accessing the services\/work offered and ordered through it by the beneficiary(ies)\u201d;<\/li>\n<li>\u201cThe platform defines the conditions and\/or limits for the remuneration for the services\/work\u201d;<\/li>\n<li>\u201cThe platform receives the payment for the service\/work that is to be delivered or has been delivered by the person providing or willing to provide a service\/work through it\u201d;<\/li>\n<li>\u201cThe platform controls the quality of the work\/service provided by the person providing or willing to provide a service\/work through a platform\u201d;<\/li>\n<li>\u201cThe platform issues a classification for the people providing or willing to provide a service\/work through it\u201d;<\/li>\n<li>\u201cThe platform is responsible for the interaction between the beneficiary and the person providing or willing to provide a service\/work through it\u201d;<\/li>\n<li>\u201cThe platform may decide to exclude the person providing or willing to provide a service\/work through it and no longer grant him\/her access to the platform\u201d.<\/li>\n<\/ul>\n<p><strong>The existence of an employment contract\u00a0<\/strong>between the platform and the person providing a service\/work\u00a0<strong>results in the application of the legal framework applicable to employees<\/strong>\u00a0(with an adjustment to the particular working conditions of the person providing the service\/work).<\/p>\n   \n<\/div>","protected":false},"excerpt":{"rendered":"","protected":false},"author":8,"featured_media":0,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[1],"tags":[],"country":[],"class_list":["post-40952","post","type-post","status-publish","format-standard","hentry","category-article","entry"],"_links":{"self":[{"href":"https:\/\/castegnaro.preprod.web-sites.lu\/en\/wp-json\/wp\/v2\/posts\/40952","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/castegnaro.preprod.web-sites.lu\/en\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/castegnaro.preprod.web-sites.lu\/en\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/castegnaro.preprod.web-sites.lu\/en\/wp-json\/wp\/v2\/users\/8"}],"replies":[{"embeddable":true,"href":"https:\/\/castegnaro.preprod.web-sites.lu\/en\/wp-json\/wp\/v2\/comments?post=40952"}],"version-history":[{"count":4,"href":"https:\/\/castegnaro.preprod.web-sites.lu\/en\/wp-json\/wp\/v2\/posts\/40952\/revisions"}],"predecessor-version":[{"id":41276,"href":"https:\/\/castegnaro.preprod.web-sites.lu\/en\/wp-json\/wp\/v2\/posts\/40952\/revisions\/41276"}],"wp:attachment":[{"href":"https:\/\/castegnaro.preprod.web-sites.lu\/en\/wp-json\/wp\/v2\/media?parent=40952"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/castegnaro.preprod.web-sites.lu\/en\/wp-json\/wp\/v2\/categories?post=40952"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/castegnaro.preprod.web-sites.lu\/en\/wp-json\/wp\/v2\/tags?post=40952"},{"taxonomy":"country","embeddable":true,"href":"https:\/\/castegnaro.preprod.web-sites.lu\/en\/wp-json\/wp\/v2\/country?post=40952"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
